State Senator Ted Harvey, who works as a mortgage broker for Greenwood Village-based American Home Funding, is under investigation for allegedly misleading consumers with advertising fliers that look like official tax documents. The Associated Press quotes Colorado Division of Real Estate Director Erin Toll as saying her staff believes the Republican’s actions violate the law. Fliers feature the Statue of Liberty and Federal Housing Administration notice codes with the words “Urgency: HIGH” and “a call to action is required.” Although they look official, the small print clarifies that they’re not government documents. Harvey defends the advertising as within legal bounds and provides another possible motive for the investigation: He recently clashed with Toll’s division after proposing legislation that would relinquish Toll’s authority to investigate mortgage brokers and set up a board similar to boards in the same division that hear complaints against real estate agents and appraisers. That detail could play against Harvey, however, as ColoradoPols, for instance, calls it the investigation’s “kicker.”
