A state-wide ban on smoking in restaurants advanced today when it won tentative approval in the Senate. A late amendment will limit the ban to restaurants that serve alcohol. It won’t apply to casinos or bars.

Violators would have to pay a $200 fine for the first offense, $300 for a second offense in the same calendar year and $500 for every violation after that during the same year.

It is believed that the amendment will give the bill a greater chance of passing. Many cities and counties have already passed a ban on smoking, including:

Fort Collins, Greeley, Pueblo, Alamosa, Arvada, Aspen, Boulder, Longmont, Louisville, Montrose, Snowmass, Superior, Telluride and unincorporated Boulder County.
