Earlier this week, Denver police officers responded to a 911 call from the 3100 block of Gaylord Street in the early morning hours to find Marcus Duran, 17, lying on the porch of a house. Duran, a suspected burglar, had been shot several times in the head and was pronounced dead at the scene. Another suspect was arrested, and a third remains at large. The person in the home at the time—whom police have yet to name—was briefly detained and then released, as Denver’s District Attorney’s Office determines whether the shooting was justified under Colorado’s “Make My Day” law, which allows people to use deadly force to ward off intruders in their homes, according to Fox 31. Duran’s family is not making any excuses for the boy’s behavior, but questioned the actions of the shooter: “Why does he deserve to get shot in the head two, three times?” asks Duran’s godmother, Phyllis Chavez. As Westword notes, “there’s no telling at this point” whether the shooting was one that officials will consider justifiable. The case is still under investigation, and Whittier neighborhood residents on the block—a line of neat brick homes—are shocked to have heard of the incident, according to The Denver Post.
